No more "illegal" than fansubbing and downloading it in the first place.U.S. distributors haven't bought the rights to the Naruto anime, yet, so fansubbers and people who may sell the episodes are pretty much given a pass.
That changes once a U.S. company buys the license to distribute a given anime in this country. THEN, fansubbers, downloaders and sellers of such anime ALL run the risk of running afowl with U.S. authorities... contrary to what many on this message forum would have you believe, or would like to believe themselves. At that point, it's the same situation we have with music companies and the downloading/trading of mp3s. You can do it, but do so at your own risk.

And we get open arms and a big smile, from the Japanese Animation Production companies. Why?, they don't care if we are, somehow able encode there episodes, and distribute them. Because it is promotion. AS LONG AS THERE IS NO SELLING OF THE ANIMATION, THE ANIMATION PRODUCTION COMPANIES WELCOME FANSUBBING, AND IN MANY CASES SUPPORT IT, AND CONTRIBUTE TO IT. AT UCLA FOR EXAMPLE, THERE IS A TIGHT NITCH BETWEEN ANIMATION PRODUCTION COMPANIES AND THE CLUB. WHY?, BECAUSE, THE BASIC FUNDAMENTAL IDEA IS THAT THE ANIMATION WILL BECOME POPULAR TO A CERTAIN POINT, IN WHICH, A RESPECTABLE, REPUTABLE, DISTRIBUTOR, WILL COME ALONG AND PURCHASE DISTRIBUTION RIGHTS. If we fansubbers betray this mechanism, and start the selling, and destroying the trust, given to us, by the Japanese Animation Industry, were fucked. LOL... you guys are funny! :) Such intelligent responses. All to argue that trafficking in pirated material from Japan over the internet (often already licensed here in the U.S.) is somehow legal, while offering that same material to people willing to buy it, isn't.The chances that Japanese animation companies are going to do anything about anyone who distributes their stuff (whether fansubbers or sellers) but doesn't affect their profits is ZERO. The episodes that I'm selling aren't offered in Asia (where Naruto is currently available), so I'm not hurting them one bit. I AM, however, helping them by increasing access to Naruto to people who might otherwise never be able to view this anime, but would like to.
Likewise, until a U.S. company picks up the rights to the show, I'm not dipping into anyone's profits over here, either... or infringing on anyone's copyright in this country. Fansubbers certainly have no rights regarding the shows they subtitle. They're simply tolerated and used to spread awareness of anime... until someone from this country DOES purchase the rights. Then both the fansubbers AND the sellers can get into hot water for infringing on someone else's trademarked property and hurting their business.
