I would like to know the legality of a employee taping or recording conversations in the workplace without the other employees knowledge. Is this legal?

Not in California. There is a penal code provision (Section 632) preventing eavesdropping on 'confidential communications.' There are other privacy protections in California as well (the common law of privacy; the California Constitution, Article I, Section, 1).
